CANDO MUNICIPAL ORDINANCES

We are in the process of updating the Municipal Code. This was last done in 1986. This page will provide information on what changes are planned and what is being discussed. Any input is welcome!

Open Burning

The updated ordinance will continue to prohibit any open burining within the city. It will, however; allow people to burn wood and kindling in an "approved container". This will allow backyard fires in enclosed fireplaces. To be approved it will need sides and a cover to contain embers. No "uncontained" fires will be allowed. Burning matierals other than wood is also not allowed. Violation of this ordinance is an infraction, with a maximun fine of $500.

Also a quick reminder to use common sense with backyard fireplaces: Keep it away from combustible materials such as decks or fences. Keep a means of controlling or extinguishing the fire nearby( garden hose or fire extinguisher). Watch the wind speed and direction, avoiding fires in high winds and where any smoke may become a nuisance.

Curfew

The curfew ordinance was recently passed, and is now in effect. The old ordinance prohibited children under 18 from being on the street after 12:30 am on Saturday (Friday nights) and 12:30 am on Sunday (Saturday nights). All other nights the curfew was at 10:00 pm. There were exceptions to this of course.

This ordinance was not often enforced in the past. Many feel that 10 pm was too restrictive, especially to 16 and 17 year-olds. Also there was not any extra time allowed in "summer".

The new ordinance sets different times by age, with an extra hour being given on weekends and in the summer. Also 17 year-olds are exempt. Here are the new times:

Ages 14 and under: 10pm. 11pm weekends and summer.

Age 15: 10:30pm.11:30pm weekends and summer.

Age 16: 11:00pm. Midnight weekends and summer.

Again these new hours are now in effect.

Off Highway Vehicles(ATV's)

The new OHV ordinance has been passed. OHV's will be allowed on the city streets. Here is a summary of some (not all) of the restrictions on the operation on city streets: First the vehicle must be licensed. The vehicle can not travel in excess of 15 mph, and can not be operated in a careless, reckless, or negligent manner. The OHV must have a working muffler/exhaust system. Children under the age of 18 must wear a helmet. The operator must have a valid drivers license. Any operator under the age of 16, must have a drivers license or has taken a saftey training course.

Penalty for a violation of any portion of this section is an infraction. The fine can be up to $500.00. The current bond for a violation has been set at $100.00.

This ordinace does not extend to people operating on one's own private land in the city.

The best place to operate the OHV for recreational purposes is outside the city. This ordinace allows for travel to and from and through the city. This ordiance will be strictly enforced by the Cando Police Department (and yes our squad's radars can get a speed of an OHV). If you have any questions, feel free to contact the department.

This ordiance includes only OHV's. Snowmobiles are not included in this ordinace.
